For employers: salary recourse in the event of personal injury

Claiming compensation as an employer from the causative agent of the accident is called wage recourse in the event of personal injury. This is because you, as an employer, are suffering damage through no fault of your own, because a wage payment obligation in the Netherlands sometimes lasts up to two years. You can also hold the cause of the accident liable for the costs that you, as an employer, incur in bringing a sick employee back to work.

If a colleague is the cause of the accident (link to page: colleague's industrial accident), different rules apply. After all, as an employer, you also have a duty of care for the colleague.
